The General Terms and Conditions of Business of Happy Summer Sky LTD. define the terms under which the seller will conduct its activities towards users through its website www.legendland.hr (hereinafter referred to as the “website”).

MAIN PRODUCT FEATURES

The service we provide consists of selecting and purchasing tickets and memberships for the Legendland theme park and water park (hereinafter referred to as “Legendland Park”).

The online sale of tickets and memberships for Legendland Park is intended to facilitate and expedite the process of purchasing tickets and memberships for Legendland Park for personal, non-commercial use.

The ticket price is significantly reduced and can be paid in 24 interest-free instalments. Members are required to keep their banking information up to date so that we can charge them over the course of 24 months.

By purchasing tickets, users contribute to and support the project and are considered members of the project. We commit to disclosing and providing all financial data and reports and keeping you informed of every step in the project’s progress.

We are currently in the development phase, and it is possible to continuously amend the General Terms and Conditions of Business to improve our website and services.

The project’s location may change.

The General Terms and Conditions of Business also include the Privacy Policy.

The member is obliged to provide accurate information for those who wish to use this membership.

CONTRACT FORMATION PROCEDURE

These General Terms and Conditions of Business also serve as a pre-contractual notice and apply to the conclusion of a sales contract if the buyer is a consumer, i.e., any natural person who enters into a legal transaction or acts on the market outside their trade, business, craft, or profession, and if the contract is concluded between the trader and the consumer as part of an organized system of sales or service provision without the simultaneous physical presence of the trader and the consumer at one location, where only one or more means of remote communication are used for contract formation.

Legal entities as buyers are subject to the provisions of the Civil Obligations Act and the Electronic Commerce Act, and the Consumer Protection Act does not apply to them. These General Terms and Conditions of Business apply to legal entities in part relating to price and payment method, main characteristics of the product, contract formation procedure, general information, disclaimer, and the moment of contract formation. The seller may, at its discretion, provide legal entities with rights that a consumer has in each specific case.

The consumer, as a buyer, enters into a sales contract with Happy Summer Sky LTD. (hereinafter referred to as “Happy Summer Sky LTD.”) as the seller.

Formation of a contract through the website constitutes distance contract. Means of remote communication include all means that can be used without the simultaneous physical presence of the trader and the consumer for the purpose of distance selling, such as the internet and electronic mail.

The official language for contract formation is the Croatian language.

The user is a person who uses the website, the same as any buyer and website visitor.

Contract formation through the website is regulated in accordance with legal provisions, taking into account, in particular, the principles and provisions of European Union directives.

The purchase is made on www.legendland.hr website by filling out the provided form. When filling out the form, the buyer must enter all the required information. The purchase can be made with the confirmation of the buyer that they have previously read and understood the General Terms and Conditions of Business and have agreed to them, and that they are aware that this is an order with an obligation to pay. Purchases can be made 24 hours a day, 7 days a week. Happy Summer Sky LTD. is not responsible for the costs of using computer equipment and telecommunications services necessary to access the service. The buyer will be notified by email of the order confirmation (receipt of an electronic message containing the buyer’s offer).

The purchase of products and/or services in the name and on behalf of minors or persons deprived of legal capacity (in whole or in part) can only be requested by their legal representatives.

Purchasing is done by ordering available products selected by the buyer based on a photograph and basic product description. Photographs are illustrative and may not always correspond in all details to the available products. Purchasing is done in several simple steps from the comfort of the buyer’s home, from anywhere in the world.

Products can be searched for by various criteria. By entering a specific term in the “Search,” products related to that term will appear. The buyer can choose a specific product of interest and read the available product description to independently decide whether the product suits their needs. The buyer selects tickets from the Happy Summer Sky LTD. product catalogue, which is organized by product type.

Product ordering is done electronically. By clicking the “Add to Cart” icon, the selected product is added to the shopping cart. Placing a product in the shopping cart does not reserve, order, or purchase the product. The buyer can continue to add products by clicking “Continue Shopping” or review the shopping cart by clicking “Review Cart,” or complete the product selection process by clicking “Complete Purchase.” When the buyer completes the product selection process by clicking “Complete Purchase,” they will be redirected to a page where they select the payment method, delivery method, enter a code if they have a coupon or gift voucher, add additional notes if any, and check the appropriate box if they want an R1 invoice. The purchase cannot proceed without checking the box “I agree to the General Terms and Conditions of Business,” by which the buyer confirms that they have read and understood these General Terms and Conditions of Business and agree to them, and by checking the box “I am aware that the order includes an obligation to pay.” By clicking “Change Cart Contents,” the buyer can modify the cart contents. If the buyer agrees to purchase the products in the shopping cart, they can click the “Pay” icon. After the buyer presses the “Pay” icon to place an order, the seller will send an email confirmation of the order to the buyer’s email address along with the order number, confirming that the buyer’s order has been received and is in the process of being processed.

The seller will send the buyer an email confirmation of the concluded sales contract along with the purchased product to their email address.

If the buyer does not receive the ordered products they have paid for within 7 working days (Saturdays, Sundays, and non-working days excluded) from making the payment, or within 7 working days (Saturdays, Sundays, and non-working days excluded) from the conclusion of the sales contract, they are obliged to inform Happy Summer Sky LTD. at the email address [email protected].

If the buyer has not received a purchase confirmation by email within 24 hours or is unable to access the service as stated in the email, they must contact the seller at the email address [email protected] or by phone at +385 01 6386318 from Monday to Friday (non-working days excluded) from 9 a.m. to 3 p.m.

In case Happy Summer Sky LTD. is unable to deliver any of the ordered products for any reason, an employee of Happy Summer Sky LTD. will contact the buyer by phone or email to arrange for the delivery of a substitute product or to cancel the ordered product.

In case of problems or uncertainties during the order, the buyer can contact Happy Summer Sky LTD. at the email address [email protected] or by phone at +385 01 6386318 from Monday to Friday (non-working days excluded) from 9 a.m. to 3 p.m.

PRODUCT PRICE, PAYMENT METHOD, AND PRODUCT DELIVERY

The ticket prices are clearly indicated and visible at every stage of the purchase. There are no hidden costs or additional fees during the purchase process. Payment on our service can be made using Mastercard, Maestro, and Visa cards.

Payment is made through the Monri WSPay online payment system. Monri WSPay is a secure online payment system, providing real-time payments, credit and debit cards, and other payment methods. Monri WSPay ensures secure entry and transmission of card data, confirmed by the PCI DSS certificate it holds. Monri WSPay uses an SSL certificate with 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection during registration and data transmission.

As an executor of credit card authorization and payment, Monri WSPay processes personal data as a processor and processes personal data in accordance with the General Data Protection Regulation of the European Parliament and Council No. 2016/679 and strict PCI DSS L1 data protection and data transfer regulations.

Monri WSPay uses an SSL certificate with 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection during registration and data transmission.

Personal data used for authorization and payment, or in the execution of obligations under the contract or based on the contract, is considered confidential data.

To fulfill the contract (authorization and payment), the following personal data of the user is required:

Monri WSPay does not process or use this personal data for any purpose other than the execution of the authorization and payment agreement.

Monri WSPay guarantees compliance with all conditions specified in current personal data processing regulations, including taking all necessary technical, organizational, and security measures, as confirmed by the PCI DSS L1 certificate.

Customers can purchase tickets and memberships for Legendland Park in advance on the website.

The contract is concluded when the seller accepts the customer’s offer, and everything listed on the website represents an invitation to make an offer. Customers can purchase tickets and memberships for Legendland Park in advance on the website. The sales contract is considered concluded at the moment when the payment is successfully executed. After that, as confirmation of the conclusion of the sales contract, the customer will receive a voucher via email. The invoice will be issued later at the checkout. If the customer wishes to receive the invoice earlier, they can request it at [email protected].

Customers are obliged to pay a monthly subscription. If the card is stolen, damaged, expired, or for any other reason, we cannot charge the subscription for more than 2 months; the customer’s membership terminates, and Happy Summer Sky LTD. has no obligations towards the customer. The customer is required to print or have the Legendland Park voucher ready on their mobile device when entering the park. When entering Legendland Park, it is necessary to scan the ticket’s QR code, allowing entry into Legendland Park. Personal ID numbers provided when purchasing memberships will be verified before entering Legendland Park. The customer must not transfer their ticket or membership to another person to enter Legendland Park. The ticket must be kept during the stay in Legendland Park. After the opening of Legendland Park, the customer can request the transfer of ownership of the membership to another person. For the transfer of ownership, we will charge the customer a fee of €50 for the transfer process.

If the project is canceled, the ticket purchase amount will be fully refunded to the customer. In the event of delays in the opening of the park, we will compensate by offering discounts in restaurants and shops.

The user agrees that access to the website may sometimes be interrupted or temporarily unavailable.

Happy Summer Sky LTD. is not responsible for any irregularities, omissions, or deficiencies that may arise during data entry, printing, scanning, or formatting. Furthermore, Happy Summer Sky LTD. cannot be held liable for any damage, losses, or expenses that may arise as a result of using or inability to use the information available on these websites.

Happy Summer Sky LTD. reserves the right to disable user access to the website if it is determined that it is being used inappropriately. Happy Summer Sky LTD. reserves the right to refuse access to the website to anyone based on its own assessments. Users are obliged to use the website in a way that does not compromise its resources and services. Inappropriate use of the website is prohibited and results in access being revoked.

The user is obliged to keep their user account data confidential and is fully responsible for any damage caused by unauthorized use of their user account.

Happy Summer Sky LTD. reserves the right to change or amend these General Terms and Conditions of Business at any time. Changes take effect on the day of publication on the website. Continued access to the website or use of any part of its content will be considered as consent to the amended or supplemented General Terms and Conditions of Business. Happy Summer Sky LTD. advises periodic checking of the General Terms and Conditions of Business for any changes.

Happy Summer Sky LTD. reserves the right to change, amend, or discontinue any part of its business, including the website or any part thereof, services, or services provided through them, at any time and without prior notice. This right includes, but is not limited to, changes in the availability of content, availability of new data, transfer methods, and the right of access or use of the website.

RIGHT TO UNILATERALLY TERMINATE THE CONTRACT

The customer has the right to unilaterally terminate the contract within 14 days of purchasing tickets. The 14-day period begins from the day the ticket is delivered to the customer or a third party designated by the customer, other than the carrier.

After the expiration of the 14-day period from the date of contract conclusion, the buyer does not have the right to unilaterally terminate the contract.

During the project execution process, the buyer does not have the right to terminate the contract based on the provisions of the Civil Obligations Act relating to material and legal defects.

In order for the customer to exercise the right to unilaterally terminate the contract, they must inform the seller of their decision to unilaterally terminate the contract before the expiry of the 14-day period, by submitting an unequivocal statement sent by mail to the address of Happy Summer Sky LTD., Zagreb, Ulica Vjekoslava Heinzela 62A, or by email to [email protected], including their name and surname, address, phone number, fax number, or email address. The seller will provide confirmation of the receipt of the statement of unilateral termination of the contract to the customer without delay, by email.

Information about the product (ticket description, price, etc.) displayed on the seller’s web store is subject to errors, application irregularities, other technical irregularities, printing errors, and similar issues.

The seller reserves the right to unilaterally terminate the contract.

In the event of contract termination, each party is obliged to return what it has received under the contract to the other party. The seller must make a refund using the same payment method that the customer used for payment, unless the customer expressly agrees to a different payment method, and assuming that the customer is not obliged to pay any additional costs for such a refund.

When the customer is a legal entity, the section of these General Terms and Conditions of Business entitled “Right to Unilaterally Terminate the Contract” does not apply to them. Legal entities are subject to the Law on Obligations and the Law on Electronic Commerce.

NOTICE OF HOW TO SUBMIT A WRITTEN COMPLAINT BY A CONSUMER

All complaints under Article 10 of the Consumer Protection Act may be sent by the consumer by mail to the address of Happy Summer Sky LTD., Zagreb, Ulica Vjekoslava Heinzela 62A, or by email to [email protected].

In order for Happy Summer Sky LTD. to respond to a written complaint from a consumer that is not sent by email, consumers are requested to provide accurate information about their name and surname, and the address to which the response will be delivered. A response to a consumer’s complaint must be provided in writing by Happy Summer Sky LTD. within 15 days of receiving the complaint.

In the event of a dispute, Happy Summer Sky LTD. and the consumer will resolve it amicably, and if not possible, the competent court is the Municipal Civil Court in Zagreb, applying Croatian law. Dispute resolution is possible at the Croatian Chamber of Commerce Court of Honor or other mediation centres.

Consumer disputes can be resolved through the European Commission’s ODR platform at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=HR

If the consumer accepts the General Terms and Conditions of Business, they also accept all other terms listed on the website and all other provisions on that website. If a consumer disagrees with any part of the pre-contractual notice or the General Terms and Conditions of Business, they are requested not to use the website and not to enter into a sales contract.

The General Terms and Conditions of Business of business comply with the laws of the Republic of Croatia.

The rules on written consumer complaints do not apply to legal entities, and the laws on obligations and electronic commerce apply to them.

INTRODUCTION

The website www.legendland.hr is provided by Happy Summer Sky LTD. Protection of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) of the European Parliament and Council No. 2016/679 – Regulation and implementation of the General Data Protection Regulation. 

We do not track our users, we do not sell your personal data, and we want to be transparent and inform you about how we process your personal data.

The term “personal data” means all information by which an individual can be directly or indirectly identified.

The term “data controller” means a natural or legal person who, alone or jointly with others, determines the purposes and means of processing data and is responsible for processing such data in accordance with applicable law.

The term “data processor” means a natural or legal person who processes personal data on behalf of the data controller. When we process personal data through means and for purposes determined by our business partners, we act as a data processor.

For this purpose, we process personal data based on your consent, such as name, surname, country, and email address. We also process data on email openings, bounce rates, clicks, subscriptions, and newsletter segments. We process data until consent is withdrawn, or after the recipient has been inactive for an extended period. We keep a list of unsubscribed recipients for five years.

Note: To register as a user on the Legendland platform, you must be at least 16 years old. Your personal data must be accurate, and if you encounter incorrect data on your profile, you are obliged to correct it.

When you register on our website or contact us through the contact form on our website or directly through our email address, the data you fill in (personal data such as your name, email address, phone, etc.) or send directly via email will be processed and stored to enable us to contact you and respond to your request. If you are under 16 years of age, you must provide the consent of your parents or legal guardians before providing personal data. By filling out the contact form on our website or contacting us directly via email, you guarantee that the data you have provided is correct and that you fully accept the terms of our privacy policy and the terms stated therein.

What is the purpose and legal basis for collecting your personal data?

 Taking the most appropriate actions at your request before entering into a business relationship based on the company’s business activities and legitimate interests.

How long will your personal data be retained? 

We keep personal data for the period prescribed by law. For general business activities, we keep data for 11 years, and for accounting and financial records, we keep them for 11 years from the end of the business financial year to which the data relates. In some cases where the law does not define the maximum data retention period, we keep some personal data based on a legitimate interest in case we need to defend ourselves in court or before another public body, in accordance with legal limitations (5 years). YOUR RIGHTS You have the right to information about the processing of your personal data, withdrawal of your consent at any time, correction or updating of your personal data to keep it accurate, deletion of your personal data when it is no longer needed for the stated purposes, transfer of your personal data in a prescribed format, and the right to file a complaint with Happy Summer Sky d.o.o., Ulica Vjekoslava Heinzela 62/a, Zagreb, via email at [email protected] or the competent state authority.

Your Consent By using this website, you consent to Happy Summer Sky LTD. for further collection and processing of your personal data, as well as any other data you provide through its services, in accordance with legislative regulations and all in accordance with the defined purpose in this policy. However, when we process your personal data for direct marketing purposes, you have the right to object to such processing of your personal data at any time, and in that case, your personal data will no longer be processed for marketing purposes.

Personal Data Breach We will inform AZOP as the competent personal data protection authority about any unlawful personal data breaches.

Changes to Our Privacy Policy We reserve the right to update and/or amend these privacy rules. We will notify our registered users 30 days before the change. The latest version of the privacy policy will be posted on our website with the date from which it applies.

By confirming the order, the buyer confirms that they have read the General Terms and Conditions of Business, agree with them, and acknowledge that they form an integral part of the sales contract.

Happy Summer Sky LTD. reserves the right to amend the General Terms and Conditions of Business of the website at any time and without prior notice and shall not be liable for any possible consequences arising from such changes. These changes come into effect on the day of their publication on these websites.

The scope of our services will continue to expand in the future, and therefore these terms and conditions may change at any time. If you do not agree with the changes to the terms or with specific provisions, please discontinue using our services before the changes take effect.
